1. About These Terms
These Terms and Conditions ("Terms") govern your use of the LayeredGeo website and report generation service ("Service") operated by LayeredGeo Pty Ltd ("we", "us", "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
LayeredGeo provides automated geotechnical site summary reports compiled from publicly available government spatial datasets for properties in Queensland and New South Wales, Australia. Reports are delivered as PDF documents.
Reports are generated for informational purposes only. They do not constitute professional engineering, geotechnical, or environmental advice and must not be relied upon as such. You should engage a qualified geotechnical engineer for any design, construction, or regulatory purpose.
3. Eligibility
You must be at least 18 years old and have legal capacity to enter a contract to use the Service. By creating an account you represent that you meet these requirements.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@layeredgeo.com.au if you suspect unauthorised access.
5. Payments and Credits
Reports are purchased via credits or subscription plans as displayed on the Pricing page. All prices are in Australian dollars and include GST where applicable. Payments are processed securely by Stripe.
Credits are non-refundable once consumed (i.e. once a report has been generated). Unused credits on a pay-per-report pack do not expire. Subscription credits reset monthly and unused credits do not roll over.
We reserve the right to change pricing at any time. Changes will not affect credits already purchased.
6. Refunds
If a report fails to generate due to a fault on our end, we will issue a credit refund to your account. Refund requests must be submitted within 30 days of purchase by contacting hello@layeredgeo.com.au. We do not offer cash refunds for change-of-mind purchases.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Resell, redistribute, or sublicense reports or access to the Service without our prior written consent;
- Attempt to reverse-engineer, scrape, or systematically harvest data from the Service;
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
8. Intellectual Property
LayeredGeo retains all intellectual property rights in the Service, including the software, design, and compilation methodology. Report output is derived from third-party government datasets; we do not claim ownership of the underlying source data.
You are granted a non-exclusive, non-transferable licence to use generated reports for your own internal business or personal purposes.
9. Data Accuracy
Reports are compiled from publicly available government spatial datasets that may contain errors, omissions, or outdated information. We make no warranty as to the accuracy, completeness, or fitness for purpose of any report. You accept full responsibility for any decisions made on the basis of a report.
10. Limitation of Liability
To the maximum extent permitted by law, LayeredGeo's total liability to you for any claim arising out of or in connection with the Service is limited to the amount you paid for the specific report that gave rise to the claim.
We are not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profits, loss of data, or business interruption, however caused.
Nothing in these Terms excludes or limits any guarantee or right that cannot lawfully be excluded under the Australian Consumer Law.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Changes to the Service and Terms
We may modify the Service or these Terms at any time. Material changes will be notified by email or by a prominent notice on the website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising under these Terms.
